Elder Law

Elder law refers to the legal issues that commonly affect the aging community, such as estate planning, health care, planning for incapacity, guardianships and conservatorships, protection against elder abuse, and advocacy in a number of areas.

Guardianship
A guardian is a person appointed by the court to make medical and living arrangement decisions for a person who is no longer able to do so.

Conservatorship
A conservator is a person appointed by the court to make financial decisions for a person who is no longer able to do so.

The court may appoint a guardian, conservator, or both. Upon the appointment of a guardian or conservator, the protected party loses significant control over his or her own affairs. Before seeking the appointment of either a guardian or conservator, it is imperative to explore whether a less restrictive alternative could accomplish the same goals. Examples of less restrictive alternatives include an Advanced Health Care Directive, Durable Power of Attorney, representative payee, and professional case management.

Estate Planning

A complete estate plan will typically include a Will and/or a Trust, Durable Power of Attorney, and Advanced Health Care Directive.

Will
A will is a document that explains how you want your assets to be distributed after your death. In the will, you may name the person who you want to manage your assets upon your death, and how you want your minor children to be cared for. A will is admitted to probate. Probate is the process by which the court oversees the transfer of ownership of your assets upon your death.

Trust
A revocable living trust is an important component of many estate plans. One feature of a trust that is attractive to many clients is that it avoids the probate process, which can save both time and money.
