Cannabidiol Is a Hot Topic in Midwestern State Legislatures

As it happens, this summer at least four different state legislatures in the midwestern U.S. either recently passed or are considering laws that would allow their citizens to have access to cannabidiol—at least in some form. This heightened attention to cannabidiol is illustrative of the growing recognition that science, politicians, and the general public have of its potential health benefits. Here is a brief overview of the ongoing discussion of CBD in these four states:
Wisconsin
In Wisconsin, lawmakers are considering a bill that would allow citizens to own and use cannabidiol for the specific purpose of treating some types of childhood seizures. Even if the bill is approved and signed into law, the production and sale of cannabidiol within the state of Wisconsin will still be illegal. This kind of conundrum will be common across the country until the various state and federal laws governing cannabidiol and similar compounds line up with one another more closely.
Nebraska
Early in June, Nebraska passed a law with a far narrower scope than the Wisconsin bill, but still significant for the issue of cannabidiol research. The law approved a single study, to be conducted by the University of Nebraska Medical Center, researching the same childhood seizure topic addressed by the Wisconsin bill. The law was somewhat overshadowed by another bill that moved through the legislature at the same time but failed to gain approval; that bill would have allowed the prescription of marijuana for medical use in some situations.
Oklahoma
The governor of Oklahoma recently signed a law to allow research of cannabidiol, or CBD, within the state. This law is broader in scope than the Nebraska law, which applied specifically to one individual proposed study.
Texas
The new law recently passed in Texas is perhaps more significant than any of the three discussed above. Under careful state regulation and with a number of conditions, people suffering from epilepsy will be permitted to purchase and use cannabidiol as a form of treatment. Many people who are unfamiliar with the differences between CBD and marijuana mistakenly see this law as an indication that Texas is moving toward legalizing marijuana as the state of Colorado has. In fact, cannabidiol is separate from marijuana-derived products, and the state legislature and governor clearly recognize that fact.
These four snapshots from the central region of the United States show just how strong the trend is toward acceptance of cannabidiol as a valid treatment, specifically for seizures that don’t respond to other existing medications. The Nebraska and Oklahoma laws encourage the detailed study of CBD, which is critical for the nation’s understanding and eventual approval of the product for widespread use. The Wisconsin law (if approved) and the Texas law go a step further, placing CBD directly in the hands of people who desire to try it as an alternative way of treating epilepsy and other types of seizures. The coming months and years promise far more action in other state legislatures along the same lines.
